1. Introduction

Welcome to IDAVA Global. These Terms of Service ("Terms") govern your access to and use of our website (idava.global) and all related services, including our job application portal, our Customer Portal for clinic accounts, and our Doctor Collaboration Portal.

By accessing or using any part of our website or services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

These Terms apply to the following categories of users:

  • Visitors — anyone browsing the public website
  • Job Applicants — individuals applying for positions through our recruitment portal
  • Clinic Customers — clinics and dental practices with an active iStoma/iClinic subscription
  • Collaborating Doctors — medical professionals linked to a clinic using our platform

2. Who We Are

IDAVA Global is a brand of IDAVA Solutions SRL, a technology company specializing in software solutions for the medical and dental industry. Our products — including iStoma, iClinic, and related platforms — are used by healthcare professionals in Romania and beyond.

3. General Use of the Website

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Attempt to gain unauthorized access to any part of our systems, accounts, or infrastructure
  • Submit false, misleading, or fraudulent information through any form or portal
  • Use automated tools to scrape, crawl, or harvest data from our website
  • Interfere with or disrupt the integrity, availability, or performance of our services
  • Attempt to bypass, reverse-engineer, or circumvent any authentication or security mechanism
  • Use our services in any way that violates applicable Romanian or EU law

We reserve the right to suspend or terminate access for any user who violates these Terms, without notice and without liability.

4. Job Application Portal

Our website includes an online recruitment and assessment portal. By submitting a job application, you acknowledge and agree that:

  • The information you provide (including name, contact details, CV, salary expectations, and assessment responses) will be collected and processed solely for recruitment purposes
  • You may be required to complete a multi-stage assessment process, which may include psychological evaluations, IQ tests, technical assessments, and email identity verification
  • You may select WhatsApp or Telegram as your preferred contact channel; by doing so you consent to receiving automated messages via the selected platform
  • Submitting an application does not guarantee an interview or an employment offer
  • You may not reapply for the same position within 12 months of a previous application for the same role
  • Your application data will be stored in our internal CRM system and used solely for candidate evaluation
  • Assessment results and answers are recorded and may be reviewed by our hiring team

4.1 Accepted Candidates

If your application is accepted, you will be granted access to a secure candidate portal where you will be required to upload specific onboarding documents in PDF format. By uploading these documents you consent to their storage and processing for the purpose of completing your onboarding. These documents will be handled in accordance with our Privacy Policy and applicable employment law.

We reserve the right to disqualify candidates who provide false, misleading, or plagiarized information at any stage of the process.

5. Customer Portal (Clinic Accounts)

The Customer Portal is available to clinics and dental practices with an active iStoma or iClinic subscription ("Clinic Customers"). Access is granted using the admin account credentials associated with your subscription.

By using the Customer Portal, you agree that:

  • You are an authorized representative of the clinic account you are accessing
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account
  • You will promptly notify us at hi@idava.global of any unauthorized access or suspected breach
  • Financial data (invoices, subscription status, payment history) displayed in the portal is sourced from our CRM system and reflects your account as of the last synchronization
  • Payment processing is handled by Netopia Payments; by initiating a payment you agree to Netopia's terms and conditions

5.1 Desktop Auto-Login

The iStoma desktop application may generate a temporary authentication token to enable automatic login to the Customer Portal. This token is valid for a maximum of 30 minutes from the time of generation. We accept no liability for unauthorized use of a token that has been shared or exposed by the user.

5.2 Keep Me Signed In

If you select the "Keep me signed in" option at login, we will store persistent authentication cookies on your device for up to 1 year. You are responsible for the security of the device on which this option is used. We recommend not using this option on shared or public devices. You can remove these cookies at any time by logging out or clearing your browser cookies.

5.3 Payments

  • All prices displayed are in Romanian Leu (RON) or Euro (EUR) and include VAT where applicable
  • EUR invoices are converted to RON at the BNR (National Bank of Romania) exchange rate at the time of payment
  • Payments are processed by Netopia Payments; IDAVA Solutions SRL does not store card details
  • In the event of a failed payment, the transaction will not be retried automatically — you must initiate a new payment
  • Invoices that remain unpaid for more than 30 calendar days from the due date may result in suspension of support services and software updates, in accordance with your contract

5.4 Refund Policy

All amounts paid are non-refundable. Once a payment has been accepted and the service has been activated, no refunds will be issued.

5.5 Service Delivery

Upon successful payment, the following timelines apply:

  • Service access and account upgrade begin immediately after payment is accepted
  • The corresponding fiscal invoice will be issued within 2 working days by our accounting department and sent to the email address associated with your account
  • A member of our technical team will contact you within 2 working days to schedule data migration, perform necessary configuration, provide training on new features, or gather details regarding mobile app customization, as applicable

5.6 Payment Cancellation

IDAVA Solutions SRL reserves the right to cancel a payment and reverse the associated service activation, with prior notice to the user, in the following situations:

  • The payment is rejected by the card-issuing bank
  • The transaction is invalidated by Netopia Payments (our card processor)
  • The information provided by the user is incomplete or incorrect

In the event of cancellation, neither party shall have any further obligation to the other, and no damages or penalties shall be claimed.

6. Doctor Collaboration Portal

The Doctor Portal is available to medical professionals who have been associated with one or more clinics using our platform ("Collaborating Doctors"). By using the Doctor Portal, you agree that:

  • You are the individual named in the doctor account and are solely responsible for its use
  • You will not share your login credentials with any other person
  • Prescription data, medical stamp code, and digital signature stored in the portal are your professional responsibility; you are solely liable for the medical content of any prescriptions generated
  • IDAVA Solutions SRL provides the technical infrastructure for prescription generation and accepts no liability for the medical accuracy of the data entered
  • You will maintain accurate and up-to-date information in your account
  • Deactivating a clinic association is irreversible through the portal; re-linking requires action by the clinic administrator

7. Cookies

By continuing to use our website after being shown the cookie notice, you accept our use of cookies as described in our Privacy Policy, Section 3.5.

We use strictly necessary session cookies required for the website to function. Persistent authentication cookies are only set when you explicitly choose "Keep me signed in" at login.

You may disable or delete cookies through your browser settings. Disabling strictly necessary cookies may prevent you from logging in or using the portals.

8. Intellectual Property

All content on this website — including text, graphics, logos, software, and multimedia — is the property of IDAVA Solutions SRL or its licensors and is protected by applicable intellectual property laws, including Romanian and EU copyright law. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

The names iStoma, iClinic, IDAVA, and associated logos are trademarks or registered trademarks of IDAVA Solutions SRL.

9. Third-Party Services

Our platform integrates with third-party services including iClinic CRM, Netopia Payments, Google reCAPTCHA, WhatsApp (Meta), and Telegram. Each third-party service is governed by its own terms and privacy policy. We are not responsible for the practices, availability, or content of these third-party services.

Links to third-party websites on our platform are provided for convenience only. Their inclusion does not imply endorsement.

10. Disclaimer of Warranties

Our website and services are provided "as is" and "as available", without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice.

11. Limitation of Liability

To the fullest extent permitted by applicable law, IDAVA Solutions SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — our website or services, including but not limited to loss of data, loss of revenue, or interruption of service.

Our total aggregate liability to any user for any claim arising under or related to these Terms shall not exceed the amount paid by that user to us in the 12 months preceding the claim, or 100 RON where no such payment has been made.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

12. Changes to These Terms

We reserve the right to update these Terms at any time. The updated version will be indicated by a revised "Last updated" date at the top of this page. For material changes, we will make reasonable efforts to notify affected users. Your continued use of the website or services after any changes constitutes your acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Romania and applicable European Union law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
